The general terms and conditions of sale are agreed between the person making a purchase on the online sales site www.ekoi.fr and the company JCR EKOI. The person making the purchase must be of legal age.
The buyer acknowledges having read these General Terms and Conditions of Sale and accepts them. The validation of the order by the client implies acceptance without any reservation of these General Terms and Conditions of Sale.

2. PURPOSE
These general terms and conditions of sale (hereinafter the "CGV") govern the conditions and modalities of sale of all the products presented, by the company JCR SAS (hereinafter "Ekoï"), on its website www.ekoi.fr (hereinafter the "Site"), to any adult person, having the status of consumer, as defined in the preliminary article of the Consumer Code, as well as the capacity (hereinafter the "Buyer").
Ekoï reserves the right to modify the CGV at any time. The modifications are enforceable against the Buyers from their online publication and cannot apply to transactions concluded previously. A copy of the CGV applicable at the date of the order is available upon request from the Buyer.
3. THE PRODUCTS
3.1 Product Characteristics
The characteristics of the products you order are indicated on the pages of the site www.ekoi.fr. Ekoï undertakes to present the products as accurately as possible.
All the products offered comply with French legislation.
Only the information found on the product sheet has probative value between Ekoï and the buyer. This information may be modified or deleted by the seller Ekoï.
3.2 Product Availability
The seller Ekoï commits to ship all the products ordered and paid by the buyer within the limits of available stocks.
If a product is out of stock after the buyer has finalized their order, Ekoï will inform the customer by email or phone and commits to offer them the choice of:
- A refund equivalent to the value of the out-of-stock product
- A credit equivalent to the value of the out-of-stock product, credited to the customer's account
- An exchange
In the case of a refund request, Ekoï commits to process the customer's refund within a maximum of 3 business days from the day of the customer's request. The refund will be directly made to the bank account used for the order payment.
4. THE PRICES
4.1-Generalities
For deliveries of Ekoï products made within the metropolitan territory of the European Union, the prices indicated are expressed All Taxes Included and do not include any preparation and delivery fees.
For deliveries outside the metropolitan territory of the European Union, prices are expressed excluding any applicable taxes. The Client agrees to pay, where applicable, all taxes that may be requested by the delivery Country, including VAT and any customs duties. These duties may be requested by the carrier. Ekoï cannot be held responsible in the event that the Client has not paid these taxes and duties. In case of refusal by the Client, Ekoï reserves the right to charge the Client for the shipping and return fees of the package and a flat order preparation fee (variable depending on the order: €5 to €15). In the case of refusal for personalized Glasses, Helmet, or Shoes in the Client's name, the refund cannot be made.
The price that applies is the one displayed on the product sheet at the date of purchase.
Delivery fees may be charged with your order depending on its total amount and the delivery country of the order.
The amount (price of the products and delivery fees) indicated in the order confirmation by Ekoï is the total price at the Client's charge.
The company JCR reserves the right to modify its prices at any time.
The total price of the paid order includes:
- The total price of the products purchased with any applicable discounts deducted.
- The order preparation fees.
- The shipping fees of the order.
4.2 Price Modifications
In the context of commercial operations, flash sales, or promotions, the displayed prices may temporarily decrease for a duration indicated on the site.
These potential price decreases cannot be subject to a refund request from the buyer if they had paid for the product(s) at a higher price outside of the promotion period. Conversely, Ekoï is obliged to respect the prices displayed on the day the order is validated, even in the event of an increase.
4.3 Price Display Error
The displayed prices are subject to visible errors. In case of a manifest error in the price display, Ekoï commits to contact the client to inform them and offer to pay the price difference or cancel their order if they wish.
5. ORDER PROCESS
To validate their order, the buyer must follow several steps:
- They select the products they wish to purchase on the site www.ekoi.fr from the offer available on the site.
- They must identify themselves (already created account) or create a client account on the site by entering the necessary information (name, first name, physical address, phone number, email).
- The buyer validates the information related to their order (products, price, address).
- The buyer chooses the type of delivery and the payment method they desire
- The buyer accepts these CGV (checkbox)
- The buyer validates their order via a secure payment module (SSL)
This last step constitutes the irrevocable acceptance of the sales contract.
A summary of their order is sent via an order confirmation email
We reserve the right to refuse any order from a client with whom there is an existing dispute.
6. DELIVERY
6.1 Generalities
The products will be delivered to the delivery address that the client indicated at the time of order validation:
- In a single package for orders of products in stock, non-customized.
- In two packages for orders containing a customized product.
For orders including one or more products unavailable at the time of dispatch, Ekoï reserves the right to ship the order without the unavailable products. In this case, the buyer will be refunded or credited with a voucher equivalent to the amounts of the unavailable products.
Upon receipt of the products, the client must verify the condition of the products they purchased.
6.2 Delivery Modes and Rates
Several types of delivery are possible depending on the client's choice.

Shipping fees are all taxes included. The amount of the shipping fees is visible on the "CART SUMMARY" page in the purchase tunnel and corresponds to the "Shipping Fees incl. taxes" line.
6.3 Delivery Times
The delivery time varies depending on the type and country of delivery.
We ship orders as quickly as possible. However, due to the nature of the orders and workload, the dispatch time can take up to 5 business days. Delivery times are understood from the dispatch of the order from Ekoï's premises.
For a delivery to a pick-up point, the client has 15 days to pick up their package after email notification of its availability. After this period, the package will be returned to Ekoï who will contact the client again. In the absence of a response, the order will be canceled and the client refunded under the right of withdrawal.
6.4 Returns
Our return policy allows you to return your new products (not worn during training, nor washed), with the tags attached and in their original packaging within 30 days.
For any return request, it is mandatory to validate the return request before sending back any products. If this is not done, the return request cannot be processed upon receipt.
Return fees are completely free*
*Valid in Germany, Austria, Belgium, Canada, Denmark, Spain, United States, Metropolitan France, Italy, Luxembourg, Netherlands, Poland, Czech Republic, United Kingdom. One free return per order.
In case of an exchange, it will only be possible upon receipt of the return and subject to the availability of the product at that time
The procedure is as follows:
Make the request:
You just need to go to your customer account and click on the "Product Return" section.
- Select the order concerned.
- Check the quantity of the product(s) you wish to return.
- Select one of the options: Credit, Exchange, or Refund.
- Once the return request is recorded, you will then be able to download and print your return slip to be placed inside your package and your pre-stamped return label.
Prepare the package:
- If you reuse the original package, remember to remove the first carrier label.
- Add the product(s) with their tags attached and in their original packaging.
- Add the return slip in the package.
- Add the pre-stamped return label.
- Drop your package at a delivery point.

- Attention, Helmets and glasses must IMPERATIVELY be returned in a rigid reinforced box. Any return in a soft package will result in the immediate return of the product without exchange or refund. In case of non-compliance with this instruction, Ekoï declines all responsibility for the product's condition.
Case of orders with a gift offered or a promo code with a minimum purchase amount:
Our promo codes and offered gifts have specific general conditions that you must respect to be able to apply them to your order, including a minimum purchase amount: you must spend a certain amount to benefit from the offer.
If after placing an order with a minimum purchase amount you decide to return an item, your order may no longer meet the conditions. In the case of a refund request, the refunded amount may be adjusted and/or the gift must be returned. In case of a credit or exchange request, the refunded amount will not be adjusted and the gift may be kept.
Example:
Code to benefit from €20 off for any order of a minimum of €100.
Total order amount of €150
Returned item: €60
If you make a return with a refund request, the total purchase amount becomes less than the minimum amount of €100. The refund is adjusted accordingly, and the €20 reduction is withdrawn. This means a refund of €40 will be made instead of €60.
In the case of a credit or exchange, you will retain all your benefits.
7. RIGHT OF WITHDRAWAL
In accordance with Article L.221-18 of the French Consumer Code, the Customer has a period of fourteen (14) days from the date of receipt of the order to exercise their right of withdrawal, without having to provide any reason or incur any costs other than those provided for in Articles L.221-23 to L.221-25. The Customer must submit their return request by contacting Customer Service. They then have thirty (30) days to return the products. Returned products must be in perfect condition, unworn, and in their original packaging.
In accordance with the provisions of Article L.121-28 of the French Consumer Code, the right of withdrawal cannot be exercised for helmets, glasses, and shoes that are personalized with text or design, as well as glasses with engraved lenses or printed temples containing personalized text.

8. DISPUTES AND APPLICABLE LAW, COMPLAINT HANDLING
All purchase operations carried out via the Site are subject to French law.
Any complaint can be made via the contact forms available in the "Help / Contact" tab, and the Client will be responded to as soon as possible.
In case of difficulties in the application of the CGV, the Client has the possibility, before any mediation and any legal action, to seek an amicable solution, notably with the help of a professional association of the branch, a consumer association, the European online dispute resolution service (https://ec.europa.eu/consumers/odr) or any other adviser of their choice. In the absence of an amicable solution, the Client may freely refer to the CM2C Mediator (Centre de la Médiation de la Consommation de Conciliateurs de justice) 49 Rue de Ponthieu - 75008 Paris, see the site https://cm2c.net/.
It is recalled that in general, and subject to the appreciation of the Courts, compliance with the provisions of the CGV relating to the contractual guarantee implies that the Client honors their financial commitments towards JCR.
Any dispute that cannot be resolved amicably will fall under the jurisdiction of the courts where the Client resided at the time of the conclusion of the contract or the occurrence of the harmful event.
9. PAYMENT
To finalize their order, the client has several payment methods available. The products remain the property of Ekoï until the order payment is made. Ekoï reserves the right to block or cancel an order in case of total or partial non-payment of the order.
- INGENICO:
Payment can be made through our secure order pages using your credit or debit card. Your card will be charged when you place your order and receive confirmation.
EKOI reserves the right to suspend or cancel the order, in case of non-payment of the total amount due by the buyer, or in case of a payment incident.
In case of suspected fraud, EKOI reserves the right to request any proof of identity from the buyer, to carry out any appropriate verification, and/or to have the payment made by transfer, subjecting the execution of the order to the satisfaction of these conditions.
- PAYPAL:
To use PayPal services, you must open a PayPal account. By opening and using a PayPal account, you agree to comply with all the General Conditions stipulated in these Terms of Use.
10. CREDITS AND REFUNDS
For any defective products or a delivery error on our part, a credit or a refund of the total amounts received (product + shipping fees + return shipping fees, based on La Poste rates) will be offered to the client.
The client can convert their credit into a refund directly via their client account, without notifying the after-sales service by email or phone.
11. PRODUCT WARRANTIES
The Customer benefits from the legal guarantees of conformity and hidden defects, in accordance with the legal provisions in force as referred to in the article "Liabilities - Guarantees".
In the event that the Customer refuses a delivery due to an error in the delivery contents, non-conformity, or defects in the products ordered, they must immediately contact EKOI Customer Service via the "Product Returns" section of the Website to determine the applicable return procedure (see return procedure in 6.4). The Customer may also return defective products for inspection directly to our warehouse (address below), accompanied by a dated proof of purchase and a letter explaining the reasons for the return.

The warranty does not cover normal wear and tear or damage caused by accident, negligence, mistreatment, or damage resulting from exposure of the product to excessive temperatures.
All items must be returned with their accessories and instructions, and, where possible, in their original packaging.
Specifically regarding the sale of bicycles, which themselves include spare parts (the "Complex Products"), Ekoï guarantees:
- The frame and fork for a period of 3 years
- That spare parts compatible with the Complex Products are available for a period of two (2) years from the date the product is posted online.
The warranty applies if a product proves to be defective due to a manufacturing defect.
The Customer has the legal deadline to request a credit note or a full or partial refund of the price, in accordance with the provisions of Article L.217-10 of the French Consumer Code.
The consumer has a period of two years from delivery of the goods to take action.
The consumer can choose between repair and replacement of the goods. As specified in Article L217-9 of the French Consumer Code, the seller may, however, choose a method other than that chosen by the buyer if this choice entails a cost that is manifestly disproportionate compared to the other method.
The consumer is exempt from providing proof of the existence of the lack of conformity of the good during the six months following delivery of the good. As of March 18, 2016, this period will be extended to 24 months.
The legal guarantee of conformity applies regardless of any commercial warranty that may have been subscribed to.
The consumer may decide to implement the warranty against hidden defects in the item sold.
In this case, they may choose between canceling the sale or a reduction in the sale price in accordance with Article 1644 of the French Civil Code.
12. PERSONAL DATA AND PRIVACY POLICY
These CGV are subject to the provisions of European Regulation 2016/679 of April 27, 2016, on the protection of individuals regarding the processing of personal data and the free movement of such data, as well as those of Law No. 78-17 of January 6, 1978, on Information Technology, Files, and Freedoms and any other applicable regulation that may come to supplement or replace it later.
The personal and nominative information concerning the Client is necessary for the management of their orders and the commercial relations between JCR and them. This data includes: Name, Address, Phone number, Email address, Bank card information, IP Address. In the absence of such information, JCR will not be able to provide its service. This information may be transmitted to companies contributing to these relations such as those responsible for executing services and orders for their management, execution, processing, and payment.
This information and data are kept for security purposes, to comply with legal and regulatory obligations. They may be used by JCR to send the Client promotional offers, for statistical purposes, and fraud prevention, for the legitimate interest of commercial development, technical improvement of its systems, and knowledge of its Clients and, finally, where applicable with the Client's consent, for service personalization, notably through advertisements. Depending on the choices made during the creation or consultation of their account, the Client may receive offers from the JCR company.
The Client can unsubscribe from JCR newsletters at any time either by clicking on the link in all the emails or by contacting Customer Service.
The Client can also consult and modify their personal data in their client space.
The Client has a right of access, modification, opposition, portability, limitation, and deletion of their information, as well as to define directives concerning the fate of their personal data in case of death, which they will send by simple mail to JCR, justifying their identity:

13. COMMERCIAL OFFERS
Commercial offers are exclusively reserved and applicable on the Ekoï website, unless stated otherwise.
14. APPLICABLE LAW
This contract is subject to French law, the language of the contract is French. Any dispute arising within the framework of the application or interpretation of this contract will be submitted to the French courts, which have sole jurisdiction.

INFORMATION CONCERNING THE EXERCISE OF THE RIGHT OF WITHDRAWAL
Right of withdrawal
You have the right to withdraw from this contract without giving any reason within fourteen days. The withdrawal period expires fourteen days after the day on which you or a third party other than the carrier and indicated by you take physical possession of the last good. To exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (e.g., a letter sent by post, fax or email). You may also complete and submit the model withdrawal form. All return modalities are detailed in paragraph 5.5, which we invite you to read to exercise the right of withdrawal.
